1. About these terms
These Terms of Service apply to the Kind Labs website, online courses and associated learning resources, including courses delivered through courses.kindlabs.com.au on Thinkific. Kind Labs is referred to as we, us or our. Please read these terms before purchasing or using our services. Contact us at hello@kindlabs.com.au if you have any questions.
The course description and any specific terms shown before purchase form part of your agreement with us. Separately quoted school workshops or other services are subject to the booking terms provided before you confirm that booking. Nothing in these terms limits rights that cannot lawfully be excluded.
2. Accounts and course access
Please provide accurate registration and billing information and keep your account credentials secure. Course enrolment is for the named learner unless a school or group licence has been agreed. Do not share login details or allow others to use your account. Contact us if you suspect unauthorised access.
Online courses are delivered through Thinkific. You need an internet connection and a compatible browser to access them. Course inclusions, access periods and completion requirements are those described at the time of purchase. Contact us promptly if you cannot access a purchased course so we can help.
3. Prices and payments
Prices are stated in Australian dollars unless clearly indicated otherwise. The total price and any applicable taxes or charges are shown before you complete your purchase. Payments are processed through the course platform and its payment providers.
The payment arrangement displayed at checkout applies to your purchase. Changes to advertised prices do not change the amount already agreed for an existing purchase. Please contact us about a duplicate or incorrect charge.
4. Refund Policy
30-day change-of-mind refunds: If you change your mind about a Kind Labs online course, you can request a full refund of the course purchase price within 30 calendar days of the purchase date. You do not need to give a reason, and you may request a refund even if you have started the course or downloaded resources.
To request a refund, email hello@kindlabs.com.au within that period with the name and email address used to enrol and your order number or other proof of purchase. State that you would like a refund. A request received within the 30-day period remains eligible even if it is processed later.
We will process an eligible refund without undue delay to the original payment method wherever possible. Your bank or payment provider may take additional time to make the funds available. We do not charge a fee for a change-of-mind refund.
Once your course purchase is refunded, access to that course and its included resources ends. Please stop using and delete any downloaded course materials, and do not make or distribute further copies. This does not prevent you from retaining receipts or records needed to exercise your legal rights.
After 30 days, we do not offer change-of-mind refunds under this voluntary policy. This time limit does not apply to remedies you are entitled to under Australian Consumer Law or other applicable law. The voluntary 30-day policy covers online course purchases; cancellation terms for separately booked workshops or services will be provided before booking.
Your consumer rights: Our goods and services come with guarantees that cannot be excluded under Australian Consumer Law. Depending on the circumstances, a failure to meet those guarantees may entitle you to a repair, replacement, refund, cancellation or compensation. For a major service failure, you may cancel the service and obtain a refund for the unused portion, or retain the service and seek compensation for its reduced value. For a minor service failure, we will remedy it within a reasonable time; further remedies may be available if we do not. These rights are not restricted by our 30-day policy, by starting or completing a course, or by downloading resources.
If a course is unavailable, materially different from its description, or has another problem, contact hello@kindlabs.com.au with the details so we can arrange an appropriate remedy. You are not required to accept store credit instead of a refund to which you are entitled.
5. Using our learning resources
Kind Labs and its licensors retain ownership of the course content, videos, activity cards and other resources. Your enrolment permits you to use the resources for your own professional learning and to print or share activity materials with students in the classes you teach, including through a restricted classroom learning platform.
You must not resell resources, publish them on publicly accessible websites, share the course library with other educators, or use the materials to deliver a competing commercial training product without our written permission. Keep copyright and attribution notices on copies. Contact us about school-wide or other broader use. Any separate licence supplied with a resource also applies.
6. Educational purpose and professional learning
Our courses provide educational information and practical wellbeing activities. They are not a substitute for individual medical, psychological or other professional advice, and do not provide diagnosis or treatment. Use professional judgement when adapting activities to students' needs and your school's policies.
Any accreditation or professional learning recognition applies as described for the relevant course and period. Completion requirements must be met where applicable. Check your registration authority's requirements when recording professional learning. We do not promise particular student outcomes or recognition beyond what is expressly stated in the course description.
7. Respectful and lawful use
Use our services lawfully and treat other participants respectfully. Do not post harmful or unlawful material, infringe another person's rights, interfere with the platform, or disclose identifiable student information in course discussions.
If there is a serious breach of these terms, we may restrict access where reasonably necessary to protect participants, the platform or our content. Where practicable, we will explain the concern and give you an opportunity to address it before suspending access. Urgent security or safety concerns may require immediate action. Any action will be proportionate and will not remove refund or other rights provided by law.
8. Privacy and third-party services
Our Privacy Policy explains how we handle personal information and is available at https://www.kindlabs.com.au/privacy. Thinkific and payment providers also process information as part of delivering their services and have their own applicable terms and privacy policies.
Links to third-party resources are provided for convenience. Their content and availability are controlled by their respective providers. This does not limit our obligations to you for services you purchase from Kind Labs.
9. Changes to courses and these terms
We may update course materials to keep them relevant. If a change materially affects what you purchased, we will notify you and provide any remedy required by law. We will not use updates to these terms to retrospectively remove benefits or rights agreed at purchase.
Updated terms will be published with a revised date and apply to future purchases. Any material change to an existing agreement will require your agreement where required by law.
10. Questions and complaints
For questions, support, refund requests or complaints, email hello@kindlabs.com.au. Include enough information for us to identify your purchase and understand the issue. We will work with you to resolve concerns fairly and within a reasonable time.
These terms do not prevent you from contacting a consumer protection agency, seeking independent advice, exercising payment dispute rights, or pursuing any other remedy available under applicable law.
